This Privacy Policy explains how we collect, use, and safeguard your information when you use Vyibe, our music creation platform and mobile application (together the “App” or the “Service”).

Information You Provide
- Account Information: We collect your email address and username when you create an account.
- User Profile: We ask you to build your user profile, with information such as instrument(s) played, experience level and preferred genres.
- User Content: We collect musical data you create within the App, including chord progressions and melodies derived from audio recordings (voice or instrument). The raw audio recordings are processed locally on your device to detect melodies and are not stored or transmitted unless explicitly stated for a specific feature.
- Feedback: We encourage you to communicate with us regarding the reporting of bugs, general comments about your experience and the App, and questions on how to use the App.
Automatically Collected Information
- Device Information: Device type, operating system, and unique device identifiers.
- Usage Data: Information on how you interact with the App, such as features used and session duration.
- Performance Data: Crash reports and performance metrics to help us identify and fix issues.
Permissions
To provide the Service’s core functionality, we may request the following permissions:
- Microphone Access: Required to capture voice and instrument audio for our melody detection feature. This audio is processed on your device.
How We Use Your Information
We use the information we collect to:
- Provide, maintain, and improve the App’s core functionality.
- Enhance your user experience by using the information provided to simplify the presentation of data and features to you.
- Develop and enhance our audio processing and chord-matching algorithms.
- Diagnose and fix bugs and improve App performance.
- Respond to your questions and support requests.
- Communicate important Service updates and information.
Data Sharing and Third-Party Services
We do not sell your personal information. We may share your information only in the following circumstances:
- With Service Providers: We may share information with third-party vendors and service providers who help us operate our App. This includes our AI service provider, OpenAI, L.L.C., as detailed in the “AI Assist Feature” section below.
- For Legal Reasons: We may disclose your information if required by law, legal process, or a valid governmental request.
- To Protect Rights and Safety: We may share information to protect the rights, property, and safety of our company, our users, or others.
- With Your Explicit Consent: We may share your information with other third parties with your explicit consent.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We confirm that any third party with whom we share user data will provide the same or equal protection of user data as stated in this privacy policy.
AI Assist Feature
Our AI Assist feature, which you may choose to use or not to use, provides you with contextual information about your musical creations.
- What is Shared: To provide this feature, we send the musical data derived from your input (such as the notes and chords that make up your progression) to our third-party AI service provider, OpenAI, L.L.C. We do not send your raw audio recordings.
- Data Usage by AI Provider: Per our agreement with OpenAI, your data is processed solely to fulfill your request. It is not used to train their AI models or for any other purpose. For more information, you can review OpenAI’s Privacy Policy.
- Data Storage: The AI service does not permanently store your musical content after a request is processed.
Data Security
We implement commercially reasonable technical, administrative, and organizational measures designed to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no internet or email transmission is ever fully secure or error-free, and we cannot guarantee absolute security.
Data Retention
We will retain your personal data only for as long as necessary to provide our services to you and for other legitimate business purposes, such as resolving disputes, ensuring safety and security, or complying with our legal obligations. How long we retain data depends on the nature of the information and our purpose for processing it.
Your Rights & Choices
You have certain rights regarding your personal information, including:
- Access & Control: You can view and update your account information within the App.
- Data Deletion: You may request the deletion of your account and associated data at any time. To do so, please email support@vyibe.app with the subject line “Data Deletion Request” and include your account email. We will process your request within 30 days.
International Users
If you use Vyibe from outside the United States, your information may be transferred to, stored, and processed in the United States.
Changes to This Policy
We may update this policy from time to time. We will notify you of any material changes by posting the new policy in the App, sending you an email (if you have provided one), or through an in-app notification.
California Privacy Rights (CCPA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected, the right to delete it, the right to opt-out of its sale (we do not sell data), and the right to non-discrimination for exercising your rights.
